Cherokee Pines Golf Club

1. Agreement to Terms

By downloading, accessing, or using the Cherokee Pines Cart App ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Cherokee Pines Golf Club ("Cherokee Pines," "we," "us," or "our") located at 270 County Road 382, Centre, AL 35960.

2. Eligibility

You must be at least 18 years old to create an account and use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

You must provide accurate, current, and complete information when creating an account
You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activities that occur under your account
You must notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms

4. Services Provided

The App provides the following services for Cherokee Pines Golf Club:

Tee Time Booking: Reserve tee times and manage golf reservations
Simulator Reservations: Book indoor golf simulator sessions
Food & Beverage Ordering: Order food and drinks for pickup or on-course delivery
GPS Course Navigation: Real-time positioning and distance measurements on the course
Scorecard: Track scores during your round
Announcements: Receive course updates and notifications

5. Bookings and Reservations

Tee Times

Tee time availability is subject to course conditions and scheduling
Cancellations must be made at least 2 hours before your scheduled tee time
Failure to cancel within the required timeframe may result in forfeiture of any booking fees
Cherokee Pines reserves the right to cancel tee times due to weather, course maintenance, or other operational needs
No-shows may be subject to restrictions on future booking privileges

Simulator Reservations

Simulator bookings are subject to availability and membership allocation limits
Cancellation policies vary based on membership type and timing
Unused simulator blocks do not roll over to the following month unless otherwise specified in your membership agreement

Food & Beverage Orders

All orders are subject to menu availability
Prices are subject to change without notice
Delivery times are estimates and may vary based on course conditions and order volume
Orders cannot be cancelled once preparation has begun

6. Pricing and Payment

All prices are displayed in US Dollars
Member pricing is automatically applied for verified members
Payment is processed securely through Stripe
You authorize us to charge your selected payment method for all purchases made through the App
Applicable taxes will be added to your order total
Refunds are processed according to our cancellation policies and may take 5-10 business days to appear on your statement

7. Membership

Membership benefits are subject to the terms of your specific membership agreement with Cherokee Pines
Membership status and benefits displayed in the App reflect our current records
Membership dues and fees are handled separately from App transactions
Members with account charging privileges may charge purchases to their member account, subject to account standing
Abuse of membership benefits may result in suspension or termination of membership

8. GPS and Location Services

GPS features require Location Services to be enabled on your device
GPS accuracy may vary based on device capabilities, environmental conditions, and satellite availability
Distance measurements are provided for informational purposes and should not be the sole basis for club selection
Cherokee Pines is not responsible for any decisions made based on GPS data provided by the App
Bluetooth connectivity is required for cart-based GPS tracking features

9. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Attempt to gain unauthorized access to any part of the App or its systems
Interfere with or disrupt the App's functionality
Share your account credentials with others
Use the App to harass, abuse, or harm others
Submit false or misleading information
Reverse engineer, decompile, or disassemble any part of the App
Use automated systems or software to access the App without permission

10. Intellectual Property

The App and all content, features, and functionality (including but not limited to text, graphics, logos, images, and software) are owned by Cherokee Pines Golf Club and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content in the App without our express written permission.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. CHEROKEE PINES DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The App will be uninterrupted, secure, or error-free
Results obtained from the App will be accurate or reliable
Any errors in the App will be corrected

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHEROKEE PINES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US THROUGH THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Cherokee Pines Golf Club, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the App. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

We encourage you to review these Terms periodically for updates.

15. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.

You may terminate your account at any time by contacting the pro shop.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Cherokee County, Alabama.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cherokee Pines regarding your use of the App and supersede any prior agreements.

Location Data: GPS coordinates when using course navigation and delivery features (only when the App is in use and you have granted permission)

Bluetooth Data: Connection information when pairing with golf carts

Information from Third Parties

Payment Processor: Transaction confirmations and payment status from Stripe
Membership Records: Membership status and benefits from our club management system

Provide Services: Process bookings, orders, and payments
Enable GPS Features: Provide real-time course navigation and distance measurements
Deliver Orders: Locate your cart for on-course food and beverage delivery

4. Location Data

Location data is central to the App's GPS navigation and delivery features. Here's how we handle it:

When Collected: Only when the App is open and you have granted location permission
Purpose: Course navigation, distance calculations, and locating your cart for food delivery
Storage: Location data is not permanently stored on our servers
Control: You can disable location services at any time in your device settings, though this will limit GPS features

We do not track your location when you are not using the App or when you are off the golf course premises.

5. How We Share Your Information

We do not sell, rent, or trade your personal information. We may share your information only in the following circumstances:

Service Providers

Stripe: Payment processing (see Stripe's Privacy Policy)
Apple: Push notifications and Apple Pay (see Apple's Privacy Policy)
Hosting Providers: Secure cloud infrastructure for the App

Cherokee Pines Staff

Pro shop staff to fulfill bookings and orders
Food service staff to prepare and deliver orders
Management for membership administration

Legal Requirements

We may disclose your information if required by law, court order, or governmental authority, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.

Business Transfers

In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

Encryption: All data transmitted between the App and our servers is encrypted using TLS/SSL
Payment Security: Credit card information is processed by Stripe and never stored on our servers
Access Controls: Employee access to personal data is restricted and monitored
Secure Authentication: Phone-based verification for account access

While we strive to protect your information, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security.

7. Data Retention

We retain your information for as long as necessary to:

Provide our services and maintain your account
Comply with legal obligations
Resolve disputes and enforce agreements

Booking and transaction history is retained for a minimum of 7 years for tax and legal purposes. You may request deletion of your account, subject to our retention requirements.

Access and Update

You can access and update your account information at any time through the App's Settings menu.

Location Services

You can enable or disable location services in your device settings. Disabling location will limit GPS navigation and delivery features.

Push Notifications

You can manage push notification preferences in your device settings under Notifications.

Account Deletion

You may request deletion of your account by contacting the pro shop. We will delete or anonymize your personal information within 30 days, except where retention is required by law.

Marketing Communications

You can opt out of promotional communications by adjusting your notification preferences or contacting us directly.

9. Children's Privacy

The App is not intended for children under 18 years of age. We do not knowingly collect personal information from children under 18. If you believe we have collected information from a child under 18, please contact us immediately.

10. Third-Party Links

The App may contain links to third-party websites or services. We are not responsible for the privacy practices of these third parties. We encourage you to review their privacy policies before providing any personal information.

11. California Privacy Rights

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including:

The right to know what personal information we collect and how it is used
The right to request deletion of your personal information
The right to opt out of the sale of personal information (we do not sell personal information)
